2011 – Judge orders Jobs to answer iTunes questions on This Day in Rock!

Apple Inc. Chief Executive Steve Jobs, who is out on medical leave, has been ordered by a federal magistrate to answer questions from plaintiffs’ lawyers in an antitrust lawsuit related to his company’s iTunes business.

U.S. Magistrate Judge Howard Lloyd, based in San Jose, California, ruled that lawyers representing the plaintiffs in the suit may question Jobs for a total of two hours. He issued the ruling on Monday.

Apple could appeal the ruling to a district judge, but it would likely have to make a case that the magistrate “made a big mistake,” said Professor David Levine at University of California Hastings College of the Law.

An Apple spokeswoman declined to comment, and attorneys for the plaintiffs did not respond to requests for comment.

In the class-action lawsuit, a group of consumers say Apple created a music-downloading monopoly with its iPod player and iTunes store. At issue is a piece of software called Fairplay that allowed only music bought on iTunes to be played on the iPod, according to the complaint.

One competitor, RealNetworks Inc, responded in 2004 by introducing a new technology that would allow customers to play music downloaded from its site on their iPods. Apple quickly announced a software upgrade to iTunes that once more blocked music from RealNetworks, the complaint charges.

“The court finds that Jobs has unique, non-repetitive, first hand knowledge about Apple’s software updates in October 2004 that rendered the RealNetworks’s digital music files once again inoperable with iPods,” Lloyd wrote in his ruling.

The ruling comes amid intense questions about Jobs’ health and whereabouts. Earlier this month an energetic but thin Jobs resurfaced to unveil Apple’s new iPad. His appearance helped reassure investors and fans worried about what his absence might mean for the company.

Apple failed to provide specific examples of how a deposition of Jobs would constitute “undue hardship,” the plaintiffs wrote in a court filing last December.

Lloyd said the deposition of Jobs would be limited to questions about the back-and-forth with RealNetworks in 2004. Apple had sought to prevent the deposition altogether, while the plaintiffs asked to be allowed a broader inquiry.

“By limiting the scope of the deposition, the judge is trying to avoid using this as some sort of tool for embarrassment or annoyance,” Levine said.

Should a district judge uphold Lloyd’s ruling, Levine said it would be extremely difficult for either side to appeal further.

The case is in re Apple iPod iTunes antitrust litigation, Case No. 05-00037, U.S. District Court, Northern District of California.

Apple is involved in a host of other lawsuits, both as a plaintiff and defendant, ranging from disputes over patents to antitrust allegations. On Monday, Apple sued Amazon.com Inc in a bid to stop the online retailer from improperly using its APP STORE trademark, according to a court filing.

Justin Bieber

2011 – Justin Bieber’s lock of hair sold for $40,668… WOW!

The mind blowing Hair change shocked fans to the core.  Giving chat show host Ellen DeGeneres a lock of his hair in a recent appearence,  she promptly put it up for auction on eBay reporting bids of $10,000 within one hour. When the auction was over,  Bieber’s Golden Lock sold for $40,668 with an added prize of a chance to meet the teen idol next time he appears on Ellen’s show.  The Gentle Barn Foundation is the charity that benefited.

Not Bad for a kid that just turned 17… Let’s see if he survives the Rock n’ Roll life style. We can think of a few other things to start lopping off the guy that would top that sale.

Van Halen Guitar Hero

2011 – Guitar Hero gets the AX… not the AXE.. meaning, sorry dudes… Strings are too exspensive… These days, guns are more popular than guitars, at least when it comes to video games. The company behind “Guitar Hero” said Wednesday that it is pulling the plug on one of the most influential video titles of the new century.

Activision Blizzard Inc., which also produces the “Call of Duty” series, is ending the “Guitar Hero” franchise after a run of nearly six years.

The move follows Viacom Inc.’s decision in November to sell its money-losing unit behind the “Rock Band” video games. Harmonix was sold to an investment firm for an undisclosed sum. Harmonix, incidentally, was behind the first “Guitar Hero” game.

Game industry analysts have long lamented the “weakness in the music genre,” as they call it — that is, the inability of the games’ makers to drum up demand for the products after a surge in popularity in the mid-2000s. Music games are often more expensive than your typical shoot-em up game because they require guitars, microphones and other musical instruments. While extra songs can be purchased for download, this isn’t enough to keep the games profitable.

Activision’s shares tumbled after the announcement, but investors were more concerned with the disappointing financial forecast from the company than the demise of “Guitar Hero.” As far as investors go, discontinuing an unprofitable product isn’t the end of the world, even if “Guitar Hero” fans disagree.

The company did better than expected in the fourth quarter, which ended in December, but that was already expected. After all, it launched “Call of Duty: Black Ops” in November.

That game, which is mostly set during the Vietnam War, made $1 billion in just six weeks in stores.

Activision said Wednesday it lost $233 million, or 20 cents per share in the latest quarter, compared with a loss of $286 million, or 23 cents per share, in the same period a year earlier.

Net revenue fell to $1.43 billion from $1.56 billion.

Its adjusted earnings of 53 cents per share beat analysts’ expectations of 51 cents, according to FactSet.

Revenue that’s been adjusted to account for games with online components was $2.55 billion, up slightly from $2.50 billion a year earlier. Analysts had forecast $2.25 billion.

For the current quarter, which ends in March, Activision forecast adjusted earnings of 7 cents per share, and revenue of $640 million. Analysts are looking for earnings of 10 cents per share on higher revenue of $771 million. The company’s forecast includes restructuring costs of 2 cents to 3 cents per share.

Shares of Activision, which is based in Santa Monica, Calif., tumbled 94 cents, or 8 percent, to $10.75 in after-hours trading. The stock had closed down 19 cents at $11.69.

2010 – Morrison pardon doesn’t change The Doors’ history…

Jim Morrison

2010 – Morrison pardon doesn’t change The Doors’ history…

Pardon, eh… wow… I’m impressed! slap, slap, slap…

By BRENDAN FARRINGTON
The Associated Press

TALLAHASSEE, Fla. — A hot, frenzied night in Miami changed life for Jim Morrison and The Doors. That’s something the late singer’s pardon on indecent exposure and profanity charges can’t correct.

“It made him realize he was no longer in the graces of the gods, that things could go wrong,” said Ray Manzarek, the band’s keyboard player. “Jim had a great line – in that year we had a great visitation of energy. We had the mandate of heaven. And I think at that moment, he lost the mandate of heaven.”

An arrest warrant was issued for Morrison four days after a March 1, 1969, concert at the Dinner Key Auditorium. He turned himself in, was tried the next year and convicted on two charges. Gov. Charlie Crist and Florida’s Cabinet members pardoned Morrison of those convictions Thursday.

But forgiveness can’t change history. Morrison, worried about prison time, was distracted. Other cities, worried about The Doors, canceled concerts. Morrison ended up dead in a Paris bathtub in 1971 while appealing the convictions. Would he have died if the Miami incident never happened?

“It was one of the many things that contributed to his death. I don’t give it any more credence than any of 10 other things,” guitarist Robby Krieger said. “If it had never happened, would he never have died at that time? Maybe not. It didn’t help.”

The Doors were in the middle of recording their fourth album “The Soft Parade” during the arrest. Krieger said he ended up doing more songwriting than usual.

“With a prison sentence looking at you, it’s not too much fun,” said Krieger. “He wasn’t coming up with much right at that time. It made him more prone to going out and getting drunk and just forgetting about everything.”

While Morrison had a reputation for using drugs, Krieger said it was mostly liquor the singer was abusing at the time.

Manzarek said the muses abandoned The Doors for a bit after the Miami concert, but they came back in the studio, especially during the “L.A. Woman” sessions.

“It was a magical session. In the recording studio, the magic stayed, but I think at that moment in Miami, the magic left for a little while and then came back intermittently,” Manzarek said.

The arrest caught the band by surprise.

“Nothing that out of the ordinary happened that night. It was pretty much an ordinary Doors show. In fact, the cops were having fun with us. We were having drinks with the cops after the show up in the dressing room,” Krieger said, admitting that Morrison was drunk and it showed in his performance. “Nobody got arrested, nothing happened, except the show was horrible. If I was one of the people that came, I would have wanted my money back.”

The band member say Morrison was just teasing the crowd with threats of exposing himself, but it never happened. Some who attended, though, still swear Morrison pulled his pants down enough to see what they shouldn’t have.

And the band’s concert schedule was never the same.

“City after city after city canceled. They said, ‘Do not bring The Doors into our city,’” Manzarek said. “The only places we could play in America were New York, San Francisco and Los Angeles.”

But among the “What ifs?” Krieger finds a positive.

“Who knows? If we had been just slogging out the tour dates, who knows if we would have ended up doing ‘L.A. Woman’ and ‘Morrison Hotel?’” he pondered.

The music has endured. And that’s one of the reasons why Florida pardoned Morrison.

“It’s hard not to be a fan of The Doors,” said Crist, who asked the Cabinet members to support the pardon effort before they all leave office in January.

The decision to pardon wasn’t just a matter of innocence and guilt, said Chief Financial Officer Alex Sink.

“I think we would have been right in here granting the pardon in recognition of his incredible talent and the fact that he grew up in Florida,” Sink said.

Morrison was born in Melbourne and later attended Crist’s alma mater, Florida State University. His father was a naval aviator and rear admiral in the Navy and the family moved frequently.

Sink said her 23-year-old son told her she should support the pardon and admonished her for even giving it a second thought. “He said ‘Mom, what were you thinking? Of course.’ It’s because his music has lived across generations.”

Still, Krieger finds some irony in the decision. He believes prosecutors and the judge who tried the case had political motivations to bring Morrison to trial, and there were similar motivations in the pardon.

“The whole arrest was politically motivated, you know what I mean?” Krieger said. “This whole thing about being pardoned, it’s the same thing – it’s political again. This guy he wants to get some publicity because he’s leaving office so he wants to get his name in the paper. It’s full circle.”

Crist was elected governor as a Republican in 2006 and recently lost his independent bid for U.S. Senate to Republican Marco Rubio. His term ends Jan. 4.

That said, Krieger agrees with the decision.

“It’s a good thing,” he said.

The case, 41 years later, has received an incredible amount of attention. Manzarek said he knows why.

“It just goes to show the staying power of the fascination with Jim Morrison’s penis,” he said with a laugh.

2010 – FBI Launches Investigation Into Online Protest affecting GENE SIMMONS’ Website.

According to CNET News, the FBI has launched an investigation into an online protest that allegedly took down numerous websites belonging to antipiracy and entertainment groups, as well as the US Copyright Office, a source with knowledge of the probe told CNET today.

Over the past two months, a group calling itself Anonymous, with links to the 4chan Web forum and image board, has launched distributed denial-of-service attacks (DDoS) against websites operated by the Motion Picture Association of America, The Recording Industry Association (RIAA), Hustler magazine, KISS’ Gene Simmons, The British Phonographic Industry, and other similar groups in France, Australia, Spain and elsewhere.

When Gene Simmons spoke out recently against illegal file sharing, his site, Genesimmons.com suffered outages as a result of a DDoS attack.

Myles Kennedy and Slash
2010 – SLASH And MYLES KENNEDY Perform Acoustically On Australia’s ‘Max Sessions’; More Video Footage – Oct. 20, 2010
Legendary guitarist Slash (VELVET REVOLVER, GUNS N’ ROSES) played an ultra-rare acoustic show in August in Sydney, Australia that was filmed for Foxtel’s “Max Sessions”.

According to Australia’s long-running rock station Triple M, Slash and singer Myles Kennedy (ALTER BRIDGE) performed a stripped-back seven-song set, featuring a mix of Slash’s solo material and GN’R and VELVET REVOLVER favorites.

The intimate gig happened at the Seymour Centre in the inner-city of Sydney and Triple M’s Alexis Savaidis was one of the 300 lucky fans to witness the magic.

“It was a flawless performance,” stated Alexis. “Myles blew everyone away with an impressive vocal range hitting insanely high notes. And, of course, Slash was unreal! Doing those solos on an acoustic guitar is really only one for the masters and he did it so well.”

She also said that Slash answered questions from fans during the set which revealed a lighter side to the guitar legend.

The setlist was as follows:

01. Patience
02. Back From Cali
03. Fall To Pieces
04. Starlight
05. By The Sword
06. Sweet Child O’ Mine
07. Civil War

“Max Sessions: Slash” premiered on Max this past Saturday, October 16 on Foxtel. More clips from the show can now be viewed below.

2010 – Ozzy Osbourne Cancels German Show Due To Back Troubles

September 16, 2010

Back problems have forced The Prince Of Darkness to postpone tonight’s concert in Oberhausen at the Konig – Pilsener Arena.

Osbourne pulled a muscle in his back, resulting in doctors ordering him to rest for three to four days, according to the venue’s website which indicates the date may be rescheduled.

However, at this time it is not known if the back ailment will affect future tour dates. While tonight’s show was an Osbourne headlining date, the next stop on the schedule is an Ozzfest gig scheduled for Saturday at the O2 – London.
